CPS Intervenes in Case of Baby Drowned at School Teen Says She Attempted to Flush Baby Down Toilet Last Edited: Wednesday, 02 Apr 2008, 4:04 PM CDT Created: Wednesday, 02 Apr 2008, 1:06 PM CDT Cedar Bayou Junior High School / Goose Creek CISD Photo FOX 26 News

Child Protective Services will investigate the welfare of a 14-year-old student who birthed an infant inside a Baytown middle school restroom but allegedly drowned it during an attempt to flush it down the toilet.

Officers were dispatched to Cedar Bayou Jr. High School, located at 2600 Elvinta near Highway 146, to investigate a possible miscarriage after school officials notified them that a 8th-grade student birthed a baby inside a school restroom at 10:51 a.m, Baytown Police Department Lt. Eric Freed said.

Investigators said they were notified after the teen reported the incident to a school counselor and said that she attempted to flush the baby down the toilet. Police said the baby, who was born alive, drowned in the toilet.

The middle school's principal, Gary Allen, sent a letter to parents to notify them of the incident.

"The staff closed off the restroom and kept students in class until the situation was contained, and students were then escorted to lunch," Allen said in the statement.  "I announced to students that a student had a medical issue and was receiving treatment. I assured them that everything was under control and asked them to try and remain focused on their classes."

The sex of the baby has not been released. The Harris County medical examiner will determine the exact cause of death.

Emergency officials transported the teen to a nearby hospital in stable condition.

Baytown Police Department detectives and the Harris County Medical Examiner's Office are investigating the case.

The word is that they are "considering" filing charges against the 14 year old teen who tried to flush her baby down the toilet after giving birth in a school bathroom.  What the heck?  What is there to consider?  The teen admitted that she tried to flush a living child!!!!!  OF COURSE THEY SHOULD CHARGE THIS TEEN.  She was of an age where she knew right from wrong.  Period.  What kind of fool tries to flush a child?  She deserves the harshest punishment on the books.  Then they need to check into the family situation and determine exactly WHY a fourteen year old teen was preggers.  I know there are some who are going to say....well she was probably scared....she didn't know what to do.....poor thing..... BULL!  Even a small child knows that it is wrong to kill someone. Teen preganancy is a HUGE issue that needs to be addressed.  Teach your children well - don't make them go looking for love in other places - teach them right from wrong - teach them to have respect for themselves - but most of all teach them that if they do screw up (and yes, it is a screw up to get preg. as a teen) and get pregenant then they are facing a life long responsibility that THEY will have to deal with.  Mothers quit raising your offsprings children - that doesn't mean don't help them but make sure they are the ones responsible for the childs care.  Don't help them make the same mistakes over and over.

Well I had my first child at the age of 14, and I don't consider my life a screw up. My parents taught me right from wrong, I knew better, but did it anyway. I don't know what was going through this young girls mind. Maybe she was scared. Did she even know she was pregnant? This may seem like a stupid question, but if you haven't been taught, you don't know. Had she received prenatal care? These are answers I would like to know before I say charge her.

There are so many outlets for young girls to take advantage of there is no call for this to continue happening. She could very easily have given this child up for adoption. There are so many loving people waiting to love a child, just look at any adoption website.
What I want to know is where is her parents? Why was she going to school this close to her due date? I say prosecute the teenager as well as her parents.

MsKay - sounds like you were strong enough to make your life into what you wanted it to be. Unfortunately that is not the status quo with teen mothers. You are the exception and not the rule. :-) I can't help but believe that she knew she was pregenant. At 14 you know. At 14 I did and to be honest my mother NEVER talked about sex and pregnancy with me. And that was twenty years ago! What it boils down to is that she knew right from wrong. Killing is wrong and she deliberately tried to flush that living child. To me it does not matter if she was scared - she wasn't too scared to try to get rid of the evidence. One report I read on this said that other students heard the baby crying. She made her choice and now she should have to pay for taking a life.

Fly - you're absolutely right. There are so many other options. In this day and time this is inexcusable. I think too that they should look into the family situation here. I don't know if they should charge the parents in this case but there should be some accountability for the HUGE rise in teen pregnancy. If it means charging the parents then so be it. Unfortunately the majority of teen mothers end up on welfare and the taxpayers end up having to pay for teen mothers mistakes.

This could had not been a full term baby, no way she could flush it down the toilet, I can see it being drown but not going down. SOOOO, she did this to the baby, she should be charged, if she did not know she was pregnant but had the baby and tried to flush/drown it, she is guilty as charged. Even if she was scared, guilty for killing a baby. She killed a baby, period.

Sian, I'm not saying that it was a walk in the park. There where times that I wanted to throw my hands up, but realized that I made this choice, and had to deal with it. I also had a great support system, my mom and grandmothers. I thank them to this day. Teen pregnancy is an issue that needs to be addressed. Like you said, most of the time taxpayers will end up paying for their mistakes. I talk to the young ladies in my family about this issue all the time. When my children and I frequent places, people can't believe my oldest son belongs to me, he is soo tall. I tell them yes he is, I had him very early. I tell them, I don't call him a mistake, but tell them they should not be thinking about or having sex until they are married.

MsKay - it can't have been easy. And then to succeed in life too - honey you're awesome. You had strong support and that is so important. There are a lot of parents out there who just don't care! It doesn't matter to them that their kids may be having sex at a young age and getting pregenant.

55 - My sympathy for her ended when she drowned that baby. There is NO excuse to justify that. I'm with you tho on the mental evaluation part.

Sonny - sumpin had to be wrong with this girl.

If it turns out she was retarded or developmentally delayed in some way - then of course I would urge lenience. But I still feel she needs to be charged.

Unless she was mentally challenged with a mental age of an 8 or 9 year old, she knew she was having sexual relations and that sexual relations can result in pregnancy. She would know that cessation of her periods and growing abdomen means pregnancy along with movement within. The lack of moral responsibility that school administration has today, the 14 year old could have received care without parental knowledge and the girl could have worn baggy clothes to hide the pregnamcy. If the parents knew about the pregnamcy, they would have been responsible to take the teen to prenatal care and instruction.
The fact that the teen gave birth to a live baby and put that baby head down in the toilet and drowned it while trying to flush it is premeditated murder.
"I scared" is the out excuse for all. There are so many who want to adopt. All she had to do was to take that baby to the police or hospital or other safe place and relinquish parental rights and get on with her life. Now she is a murderer who has killed an innocent.

55 - That statement about going to the counselor herself caught my eye. Says a lot about the situation doesn't it?

Foxy - I know that todays fourteen year olds know a LOT more than I did 20 years ago.

Ladies you are oh so right, there are thousands of couples waiting to adopt. My wife and I adopted our son last summer, and are planning on doing it again. God did not allow us to have our own because he wanted us to help an unfortunate child that would not be taken care of, and when I hear stories like this it truly hurts my heart!
