Sheriff: Charge Boyfriend in Case of Kansas Woman Pried Off Toilet After 2 Years

NESS CITY, Kan.  —  A man should be charged for allowing his girlfriend to sit on their toilet so long that her body became stuck to the seat, the sheriff said Thursday.

Ness County Sheriff Bryan Whipple was among authorities who discovered the woman last month living in the bathroom of a mobile home she shared with her boyfriend, Kory McFarren.

"The house was cluttered but not in shambles," he said. "The smell was overpowering — a terrible smell about the house, obviously coming from where she was at."

McFarren, 36, told police his girlfriend, Pam Babcock, 35, had a phobia about leaving the bathroom and may not have left the bathroom in two years, although he's unsure how long she was in there.

He said during that time, he brought her food, water, and clean clothes.

"The only thing I am guilty of is I didn't get her help sooner," he told The Associated Press on Thursday.

The sheriff said that judging by the woman's condition — she had open sores on which the toilet seat would stick — it appeared she likely sat on the toilet continually for at least a month.  "She would have to be sleeping on the toilet," the sheriff said.

Whipple asked the county attorney to charge McFarren for mistreatment of a dependent adult. The prosecutor did not return phone calls seeking comment.

"The unfortunate thing is this truly is a case of two people, in my opinion, with diminished mental capacity," Whipple said.

McFarren, who works at an antique store, said he has been taking care of Babcock for the 16 years they have lived together. He insisted that he tried to coax her out of the bathroom every day. The home has a second bathroom.

McFarren said he finally called police Feb. 27 after he became worried because Babcock was acting groggy, as if she didn't know what was going on around her.

What emergency responders found when they entered the bathroom has left many in the town of about 1,500 people buzzing and authorities incredulous.

Whipple said the seat was taken off the toilet so the woman could be transported to the hospital for treatment.

Doctors at the Wichita hospital told the boyfriend an infection in her legs has damaged her nerves and may leave her in a wheelchair, he said.

I read this yesterday for the first time and frankly didn't know whether it was appropriate to laugh or not.  Then I got to reading a little more and realized that whoever this woman was she was NOT all there.  From what the sheriff stated both the boyfriend and the woman are of diminished mental capacity.  If this is the case then what would be the point in charging the boyfriend?  It sounds like the boyfriend was just trying to please the girlfriend who for whatever reason decided that the bathroom was the best friend she ever had.  I don't think he should be charged with anything because I really don't think he knew any better.  Something is obviously wrong with her - how many people do you know that would let a toilet seat grow into their butt?  Don't charge the boyfriend for her insanity.  Sounds like he's dealing with enough on his own.

good morn sian hope your wekend will be good when i first read this story i had mixed feelings then when i read again i don't think the boyfriend should be charged he was just trying to please her and both had mental problems it is a sad situation that it went on for 2 yrs now that is a long time but you know it probally happens more than we know and this case just went on the longest and in the news it is sad

another thing sian nobody ever visted and no one knew what was going on that is weird or did he just make excuse shes not here or in the bathroom no friends or relitives that checked in or visted that is weird it is just goes to show you memphis is not the only place that have weird people lol lol i just had to put a joke in it because it is so weird but sad

You're right it is sad. I feel the same. I don't think he was trying to harm her - I think in his way he was just trying to help her by doing as she asked. To charge him with a crime (if he is indeed someone with a low mental capacity) would be like kicking a puppy. Just not right.

55 -I know - it's hard to not get a chuckle out of some weird ones, lol. Nope, Memphis doesn't hold the market on all the weird ones I guess.

I wondered the same thing myself - if they didn't have family then what about friends or even neighbors? It sounds like there may be a really sad lack of caring on others parts. Someone should have been checking on them on a daily basis. People who have some sort of disability often take pride in living by themselves but it doesn't negate the need for some supervision. If not by friends or family then by the state.

I don't think the boyfriend should be charge because he obviously is not playing with a full deck. They both need help but charging him would not make sense. Where is her family I wonder?

get a load of this sian off the subject but i was just on the internet a danbarry conn child 15 yrs old is suing his teacher for waking him up in class she made a loud sound when she hit her hand on his desk now what the fool doing asleep crazy now this is stupid

AH! here the crazy story, Charging the man, well I would not know why, because as we can see they both had problems and they need help, WOW! I wonder is any of her family members has tried to visit with her??

Oh my 55 this is crazy, a 15 year old is already in the wrong for sleeping, HA! boy do we have some dummies out in this world.

I took a psychology class in college that was taught by a Memphis police psychologist and some of the stories he told make this story look tame, unfortunately.

55, I also read about that story, what I read wass that the boy is suing because the teacher hit the desk so hard that it ruptured his ear drum, (not making excuses for his lazy butt).

Both of these people have mental issues. The thought of this turns my stomach. I mean sitting in the bathroom for 2 years! How did she bathe, take care of her female issues, eat?? If this place only had one bathroom, where did the man care for himself?? I would not have wanted to be the one would had to get this woman up. I can't imagine!!

Let me tell you all about this trifling, and I mean trifling girl that I saw today. While picking up the mail for my job from the post office on Winchester, I saw this trifling girl allowing a child to urinate right in the parking lot. I was getting into my car, and I saw the boy get out. She was just sitting there. I was starting my car up, and I saw this boy pull his pants down and started to urinate right there in public. I mean he did this like he does this all of the time. He didn't act shame at all, I could not believe my eyes, he looked no older than three years old. I just looked at her and shook my head and pulled off. I wanted to say something to her soooo bad. She knew what the head shake meant, but probably should care less. That's what I call trifling!!!

OMG!! MsKayTenn, there you go parents can't even make kids to the right thing, this women should had known better and went to the nearest stop were there was a restroom, and to do this out in the public and a parking lot, that shows you how some parents let their kids think it is ok to do, WOW! I am glad you looked at her and shook your head so she could see that you saw all this, but yeah she you can see that she just does not care.

55 - He should not have been asleep in class to begin with but if as Fly says, the teacher ruptured his eardrum, that punishment was a little too harsh. I've had a ruptured eardrum and it is painful. Keep me updated if you hear anything new.

Sonny - I found it hard to believe too, lol.

MsKay - you're kidding me! She allowed him to pee in public!!! Isn't that what potty training is all about????? Like Sonny said - it's not like there aren't plenty of public restrooms around....But regarding the woman on the toilet - I have no clue as to how she "took care of business." They said there was a horrible smell coming from the bathroom. Yech!

From what I understand - the toilet lid lady had had a really bad childhood so maybe there was not any family to visit.

Mskay - maybe she's from waaaaaayyyyyyyy in the boonies and doesn't realize she's in the big city now. :-)

Seriously tho - that is just not a good idea. Aside from the toileting part of it - which is a private thing - there are the issues with the nudity of a child in public. That certainly was not wise of her to allow him to do that.

i did not read that it ruptured his ear drum but he did say it was loud now if it ruptured it that is a differant story but i am not taking up for him because he shouldn't have been asleep but if it ruptured his ear drum it seems the teacher would have hurt her hand because she used the palm of her hand i don't think aloud noise like that would rupture but could have don't put nothing past these days
